The indictment issued by the Nanyang Municipal People’s Procuratorate pointed out that on the evening of July 5, 2023, Yang tricked Luo Damei into renting a house for Yu. Yu Mousheng restricted Luo Damei’s personal freedom, and teamed up with Sha Moujiao to transfer her to an idle bungalow in Nanzhao County. During this period, the two used intimidation and coercion to force Luo Damei to transfer money to Sha Moujiao’s WeChat, Alipay and bank account. In the early morning of July 7, after asking for more than 200 yuan, Yu Mousheng took the opportunity to kill Luo Damei while being alone, and pushed the body into the sweet potato cellar to bury it.

The Nanyang Municipal People’s Procuratorate believes that Yu Mousheng, Sha Moujiao, and Yang Mousheng are all suspected of robbery, of which Yu Mousheng also constitutes the crime of intentional homicide.

The focus of the controversy in this trial focused on Yu Mousheng’s crime. Yu Mousheng’s defender advocated the exclusion of the charge of intentional homicide, and put forward the following defense opinions: questioning the accuracy of the autopsy conclusion, asserting that the victim died accidentally; emphasizing that the defendant has made major meritorious contributions; Propose to cooperate with the investigation and confess the plot, etc.

According to Ms. Shang, Yu Mousheng claimed to have clues on major meritorious service, but did not disclose it in court on the grounds that it involved sensitive information, and said that he would submit it to the collegial panel separately.

Co-defendants Yang and Sha also retracted their confessions in court. Ms. Shang recalled that Yang admitted that he had participated in the plot before, but argued that he was only responsible for making an appointment with Luo Damei for Yu Mousheng, and did not know the target of extortion and the plan to divide the money. Sha Moujiao claimed that she was coerced to participate in the whole process because she was not deeply involved in the world and was beaten by Yu Mousheng.

Luo Damei’s family: Do not accept the other party’s apology

In the final statement, the three defendants apologized to Luo Damei’s family. Ms. Shang recalled that Yu Mousheng said, “If your family can spare my life, I will definitely use the rest of my life to compensate you.” In this regard, Luo Damei’s family refused to accept it. Ms. Shang said, “To this day, the trio still try to reduce or exempt their punishment through quibbles. We don’t want them to be sorry, as long as they accept the punishment of the law. ”
