On March 8, the Hunan Provincial Federation of Trade Unions issued a reminder letter on labor law supervision, reminding employers to protect the legitimate rights and special rights and interests of female employees.
The reminder letter reminds that in accordance with national laws and regulations such as the Special Provisions on the Labor Protection of Female Employees in Hunan Province and the Regulations on the Labor Law Supervision of Trade Unions in Hunan Province, employers in the province
- Except as otherwise provided by the state, men must not be limited to men or given preference to men, and women must not be refused to be hired (hired) on the basis of sex, or the standards for hiring (hiring) women must not be raised in a differentiated manner;
- In addition to basic personal information, female job seekers’ marital and childbirth circumstances must not be further questioned or investigated; Restrictions on marriage or childbirth, or marital or childbirth status, must not be made a condition for hiring (hiring).
Employers recruiting (hiring) female employees shall sign labor (employment) contracts or service agreements in accordance with law, and the contracts or agreements shall contain provisions for the protection of the special rights and interests of female employees, and shall not provide for restrictions on the marriage or childbirth of female employees. In the course of contract performance, equal pay for men and women for equal work should be implemented.
During the period of marriage, pregnancy, childbirth, or breastfeeding of a female employee, the employer shall not unilaterally terminate the labor or employment contract; During pregnancy and breastfeeding, working hours must not be extended or night work must not be arranged.
The Hunan Provincial Federation of Trade Unions supports trade unions and female employee committees at all levels in performing their duties in accordance with the law, and when an employer dismisses a female employee, it shall notify the trade union in advance and explain the reasons. When the legitimate rights and interests of female employees are infringed, they can call the 12351 All-China Federation of Trade Unions employee rights protection hotline to report.
Trade unions in many places issued reminder letters for legal supervision
During the Women’s Day, trade unions and other labor rights and interests protection departments in many places in China issued reminder letters on labor law supervision, requesting the protection of the legitimate labor rights and interests of female employees.
The Qinghai Provincial Federation of Trade Unions requires that employers shall strictly abide by the principle of equality between men and women in the process of recruitment, employment and career development, and shall not further inquire or investigate the marriage and childbirth status of female job seekers except for basic personal information; Restrictions on marriage or childbirth, or marital or childbirth status, must not be made a condition for employment (hiring); Other acts of refusing to hire (hiring) women on the basis of sex, or raising the standards for hiring (hiring) women in a differentiated manner, must not be carried out.
The trade union of the Inner Mongolia Autonomous Region said that there are no restrictions on the employment of workers in terms of ethnicity, gender, love, marriage, and childbirth.
The Fujian Provincial Federation of Trade Unions proposed that equal employment, career development, remuneration, maternity protection, help employees balance work and family responsibilities, and prevent and stop sexual harassment in the workplace should be included in the collective contract and the special collective contract for female employees.
